Appel mondial en faveur d’un mécanisme de suivi des droits humains en Chine

Dans une lettre ouverte au Secrétaire général de l’ONU, à la Haute-commissaire aux droits de l’homme et aux États membres de l’ONU, l'ACAT-France se joint à plus de 320 organisations du monde entier appelant à la création d'un mécanisme international indépendant chargé de remédier aux atteintes aux droits humains commises par les autorités chinoises.

Nous, les organisations soussignées, nous unissons pour réclamer un mécanisme international chargé de se pencher sur les violations des droits humains par le gouvernement chinois, et vous exhortons à agir de façon décisive pour atteindre cet objectif.

Le 26 juin 2020, initiative sans précédent, 50 experts des Nations Unies réclamaient des « mesures décisives pour protéger les libertés fondamentales en Chine ». Ils dénonçaient les violations massives des droits humains que commet la Chine à Hong Kong, au Tibet et au Xinjiang, la suppression d’informations dans le contexte de la pandémie de Covid-19, ainsi que les attaques contre les défenseurs des droits, journalistes, avocats et détracteurs du gouvernement dans tout le pays.

Nos organisations s’inquiètent également de l’impact mondial des violations des droits par la Chine. La Chine cible les défenseurs des droits humains à l’étranger, réprime la liberté intellectuelle dans des pays du monde entier et se livre à la censure de l’Internet et à la surveillance numérique. Nous déplorons la promotion par la Chine d’un développement sans respect des droits et la dégradation environnementale qui s’ensuit aux mains de sociétés extractives appuyées par son gouvernement, ainsi que la façon raciste de traiter certaines personnes en Chine ou, de la part de représentants de l’État chinois, dans d’autres endroits du monde.

Nous sommes consternés par les efforts de la Chine visant à dénaturer le mandat du Conseil des droits de l’homme des Nations Unies en favorisant la « coopération » au détriment de la responsabilisation et en s’opposant aux initiatives qui cherchent à examiner de près les graves violations des droits et les crimes internationaux commis dans des pays du monde entier. La Chine s’est servie de son siège au Comité des ONG des Nations Unies afin de refuser sans fondement l’accréditation d’organisations non gouvernementales (ONG), tout en accréditant des ONG organisées par les gouvernements (GONGO). Elle a cherché à refuser à des défenseurs des droits humains d’entrer dans les locaux de l’ONU, dénoncé comme « terroristes » des personnes intervenant lors d’événements parallèles organisés par des ONG, et menacé des délégués pour les dissuader de participer à des événements en marge de réunions de l’ONU portant sur des atteintes aux droits, notamment au Xinjiang.

Lorsque la Haute-commissaire des Nations Unies aux droits de l’homme, des procédures spéciales de l’ONU ainsi que des dizaines d’États ont appelé la Chine à se conformer aux normes internationales relatives aux droits humains, la Chine a rétorqué qu’il s’agissait de « remarques déplacées » portant gravement atteinte à sa souveraineté.

Un État qui s’efforce de se tenir au-dessus de tout examen critique constitue une menace fondamentale à l’égard des droits humains. Le fait que la Chine – État doté d’une extraordinaire puissance mondiale – s’attende à être traitée de la sorte nous affecte tous.

C’est pourquoi nous appuyons l’appel des experts de l’ONU en faveur d’une Session spéciale du Conseil des droits de l’homme, en vue d’évaluer l’étendue des violations commises par le gouvernement chinois et d’établir un mécanisme de l’ONU, impartial et indépendant, chargé de suivre de près et d’analyser ce sujet en produisant des rapports annuels. Nous exhortons le Secrétaire général des Nations Unies à nommer un-e envoyé-e spécial-e, conformément à son Appel à l’action en faveur des droits humains, et nous appelons la Haute-commissaire aux droits de l’homme à exécuter son mandat indépendant en surveillant les violations des droits humains généralisées commises par la Chine et en publiant des rapports à ce sujet. Nous soutenons l’appel adressé aux États membres et aux organes de l’ONU les poussant à utiliser toutes leurs interactions avec les autorités chinoises pour insister sur le fait que le gouvernement doit respecter ses obligations internationales vis-à-vis des droits humains.

Nous vous écrivons dans un esprit de solidarité et de partenariat à l’échelle mondiale, vous appelant à agir rapidement pour contrer et remédier aux graves violations des droits humains commises par les autorités chinoises. Aucun État ne devrait être au-dessus des lois.
